JUDGMENT Mr. Paramjeet Singh, J. (Oral):- Instant revision petition has been filed under Article 227 of the Constitution of India for setting aside the order dated 29.07.2013 (Annexure P/5) passed by learned Additional District Judge, Ferozepur whereby divorce petition filed by the petitioner has been dismissed. 2. I have heard learned counsel for the petitioner and perused the record. 3. Learned counsel for the petitioner contends that the divorce petition of the petitioner has been dismissed for non-compliance of order dated 25.03.2013 (Annexure P/4) whereby Airmail Registered Cover with AD was required to be furnished by the petitioner to the Court for service of the respondent. 4. Perusal of zimni orders attached with the revision petition reveals that earlier registered covers were furnished and summons were issued for 25.03.2013. As the summons was not received back served or otherwise, the petitioner was directed to furnish fresh RC/AD vide order dated 25.03.2013. The petitioner failed to comply this order. The learned trial Court has dismissed the petition under Section 13 of the Hindu Marriage Act for this lapse on the part of the petitioner. This Court feels that the petitioner cannot be punished with such a harsh order. The RC was earlier submitted, but not received back served or otherwise. 5. In the present case, this Court is of the considered opinion that ends of justice would be met if one opportunity is given to the petitioner to furnish fresh Airmail Registered Cover for the service of the respondent within a week from the issuance of order by the trial Court. 6. In view of above, present revision petition is allowed. Impugned order dated 29.07.2013 (Annexure P/5) is set aside. Petition under Section 13 of the Hindu Marriage Act is restored to its original number. 7. Since, the respondent was yet to be served before the trial Court, notice to the respondent in this revision is not necessary. --------------------
