Judgment :- 1. The petitioner seeks for issuance of a writ of mandamus to direct the respondents 1 and 2 to consider his representations dated 25.02.2005 and 26.02.2005 and to appoint him as Chief Cameraman in Tamil Nadu Films Division. Heard the parties. 2. The petitioner was appointed as News Reel Cameraman on 26.08.1988 in the Tamil Nadu Films Division under Rule 10(a)(1) of the Tamil Nadu State Subordinate Service Rules with time scale of pay Rs.1160-50-1460-70-1950. Thereafter, he was granted selection grade with effect from 09.11.1988. The next higher post in the Films Division is the post of Chief Cameraman. The said post has to be filled up as per the ad-hoc rules framed by the Government of Tamil Nadu. When a vacancy arose to the said post, the petitioner submitted his representation dated 25.02.2005 requesting to grant promotion in the light of his qualification and seniority. Since there was no reply from the respondents 1 and 2, the petitioner has filed the present writ petition with the aforesaid prayer. 3. When the matter was taken up, learned Additional Government Pleader appearing for the respondents 1 and 2, by referring to para 6 of the counter, submitted that the representation of the petitioner dated 25.02.2005 had already been examined by the Government as per the Rules and thereby approved the list in Government Letter No.10702/Ad.1/2005-4, dated 06.07.2006, wherein the name of the petitioner was shown in the third place. Therefore, as rightly found in letter dated 06.07.2006, since the representation dated 25.02.2005 of the petitioner was already considered by the Government, the petitioner cannot have any grievance, so as to issue a mandamus at this point of time. In fine, for the above said reasons, the writ petition filed by the petitioner fails and it is dismissed accordingly. No Costs.
