B. L. Santosh v. Bangalore University, Represented by the Registrar, Bangalore

2013-02-11

B.MANOHAR, DILIP B.BHOSALE

body2013
Judgment :- The appellant challenges the order dated 25th August 2012 passed by the learned Single Judge dismissing the writ petition whereby he sought direction to the first respondent to readmit him to 7th and 8th semesters of the B.E. degree course in Computer Science in respondent No.2-College. 2. There is no dispute that after 2001-02, the appellant abandoned the course, in the sense, till filing of the writ petition, he did not attend the classes. Having regard thereto, Mr. Vishnu Bhat, learned counsel appearing for the first respondent invited our attention to regulation OB-6.2 of the Regulations Governing the B.E. Degree Course and B.Arch Degree Courses (Revised Semester Scheme)-2001-2002 to contend that the appellant cannot be granted the relief as prayed for. The Regulation OB 6.2 reads thus: “OB 6.2: The candidate shall complete the course within a period of eight academic years from the date of first admission, failing which, he/she has to discontinue the course. Provided that the candidates admitted under lateral entry scheme shall complete the course within a period of six academic years from the date of first admission, failing which he/she has to discontinue the course. (Amended and approved in 74th E.C. (12-8- 2008) Res.No.6.1)” 3. Having regard to the regulations and the admitted facts, in our opinion, no relief as prayed for can be granted in favour of the appellant. Hence, the appeal is dismissed.
