JUDGMENT Kurian Joseph, C.J. The Writ Petition is filed mainly with the following prayer: “A. That this Hon’ble Court may kindly be pleased to issue the writ of Mandamus whereby the respondents may kindly be directed to implement the judgment dated 22.3.2010 passed by this Court in CWP(T) 6018/2008 titled as Madan Lal Tomar and others versus State of H.P. in letter and spirit and petitioner may be given the benefit of revised pay scale of Rs. 300-600 with further benefit of revision of pay scales affected from time to time, and difference in wages may kindly be calculated and further disbursed to the petitioners forthwith in the form of arrears.” 2. According to the petitioners, the judgment in Madan Lal Tomar’s case, Annexure P-1, has attained finality. The petitioners have also produced Annexure P-2, order passed by the Apex Court. If is further submitted that the petitioners are also similarly situated. As rightly pointed out by the learned Dy. Advocate General, the matter requires to be verified on facts. Therefore, this writ petition is disposed of with a direction to consider the case of the petitioners in the light of decision in Madan Lal Tomar’s case, in case the same has attained finality and extend a similar treatment to the petitioners herein also. However, as far as arrears are concerned, we make it clear that since the petitioners have approached this Court only in 2013, their claims shall be limited to the period of 36 months prior to filing of this writ petition. 3. The Writ Petition is disposed of, so also the pending application(s), if any.
