ORDER Heard. The petitioner was appointed as a Mazdoor on the basis that he was a land oustee and the appointment order was issued by the Additional Chief Personnel Manager, I.B. Valley, Area, Mahanadi Coal fields Ltd., Jharsuguda. Subsequently, after the petitioner worked for about 18 years, a proceeding was initiated against him for having obtained the appointment by adopting impersonation. The Enquiry Officer-found charges to have been proved. Thereupon, the second show-cause notice was issued by the Senior Manager (Mining) Colliery Manager, Belpahar under Annexure-7 granting three days time to file a second show cause. The petitioner prayed for two months time within that three days period as at Annexure-8. However, under Annexure-9, another letter was issued to the petitioner intimating him that he has been dismissed from service. The said letter has been written by the Deputy General Manager (Mining), Project Officer, Belpahar (OCM). It appears that the appointing authority of the petitioner was the Additional Chief Personnel Manager-opposite party No.3. But the notice for filing the second show-cause was issued by the other, who was not competent to do so. The dismissal order has also been issued by an officer, who is not the appointing authority. We, therefore, quash the letter asking the petitioner to file a second show cause as well as the order of dismissal under Annexures-7 & 9, since those are not issued by the appointing authority and direct that the petitioner shall be offered with an opportunity to file a second show cause by the disciplinary/appointing authority giving him at least two weeks time to file such show cause. After such notice is filed, the same shall be considered and necessary order shall be passed by the disciplinary authority with regard to the proceeding in question conducted against the petitioner. The writ application is accordingly disposed of. Urgent certified copy of this order be granted as per rules. Application disposed of.
