JUDGMENT Mrs. Sabina, J.: - Petitioner has filed this petition under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail in case FIR No.354 dated 8.7.2013 under Sections 302,449,34 of the Indian Penal Code, 1860 registered at Police Station City Bahadurgarh, District Jhajjar. Heard. 2. As per the prosecution story, at about 11.00 a.m. on 8.7.2013, Ravi Shankar and his brother-Anand and his nephew- Rajan and father of Rajan suddenly entered the house of the complainant and bolted the door of the room from both sides and started giving beatings to complainant. Rajan took out his knife and tried to kill the complainant but his son Sahil came between them and knife blow was inflicted on the right side of the forehead of his son- Sahil. Ravi Shankar, Anand, father of Rajan gave slaps and fist blows on the right eye, chest and abdomen of Sahil. Ravi Shankar, Ananad, father of Rajan gave slaps and fist blows to the complainant and his wife. On an alarm raised by them, daughter of the complainant opened the door and ran outside in the street. Om Parkash, father of the complainant and his elder brother came to the spot. Thereafter, all the assailants were fled away from the spot. 3. Learned counsel for the petitioner has submitted that the petitioner was not named in the FIR. It is only in the supplementary statement suffered by the complainant, name of the petitioner had figured. Petitioner was not related to the complainant party or the accused party. Learned counsel has further submitted that the petitioner is in the custody since 12.7.2013 and challan has already been presented in this case. 4. Learned State counsel, on the other hand, has opposed the petition. 5. In the present case, complainant, at the time of lodging of the FIR, has specifically stated that Ravi Shankar, Anand, Rajan and father of Rajan had entered his house. Complainant had not taken the plea, at that time, that some more persons had also accompanied the accused. It is only in the supplementary statement suffered by the complainant that the name of the petitioner has figured. Further petitioner was, allegedly, empty handed, at the time of occurrence, and has been attributed fist blows on the person of complainant and his wife.

Since the challan has already been presented in this case and conclusion of trial may take time, it would be just and expedient to release the petitioner on bail. 6. Accordingly, without expressing any opinion on the merits of the case, this petition is allowed.
