JUDGMENT Mr. S.P. Bangarh, J.: (Oral) - The following three suits are pending in three different Courts: 1. Civil Suit No. 115 of 2011 titled Satish Kumar v. The Registrar, Karnal and others, has been pending in the Court of Mr. Upendra Singh, Civil Judge (Jr. Division), Karnal. 2. Civil Suit No. 317 of 2010 titled Naresh Kumar and Sukhbir Singh and another, has been pending in the Court of Mr. K.P. Singh, Civil Judge (Sr. Division), Karnal. 3. Civil Suit No. 920 of 2011 titled Satish Kumar v. Balbir and others, has been pending in the Court of Mr. Mohommad. Sageer, Civil Judge (Jr. Division), Karnal. 2. The case of the petitioner is that the suit land is common in all the three suits. In order to avoid passing of the conflicting judgments in all the three suits, he (petitioner) filed transfer application No. 269 of 10.12.2012 before the District Judge, Karnal, that was dismissed vide order dated 29.10.2013 (Annexure P-7). 3. Aggrieved, against the same, the petitioner, who was applicant before the District Judge, Karnal has filed the instant revision with prayer for acceptance, thereof, and for acceptance of his transfer application for transferring of all the three suits to one Court, that was dismissed by the District Judge, Karnal. 4. Learned counsel for the petitioner contended that the suit property in all the three suits is common. Even, the District Judge in the impugned order also did not refute this averment of the petitioner. When once, it is the admitted case, that the suit property is common in all the three suits, it was required of the District Judge, Karnal to order transfer of all the three suits to one Court. Though, these could be decided independently, but those are required to be decided on one date by the one Court, in order to avoid conflicting judgments. 5. The issuance of notice of this petition shall further delay in disposal of the case. However, if the respondents are aggrieved by this order, they may approach this Court for recall of this order by way of filing appropriate petition. 6.

When, it is the admitted fact that the suit property in all the three suits is common, these must be heard and tried by one Court, though, separately, as the parties are not common in all the three suits, but in order to avoid conflicting judgments, all the three judgments in these three suits must be passed on one date. 7. Consequently, the instant civil revision is allowed; impugned order is set aside and the application filed by the petitioner, before the District Judge, Karnal, is allowed and the civil suits mentioned at serial Nos. 2 and 3 are withdrawn from the respective Courts, and are transferred to the Court of Mr. Upender Kumar, Civil Judge (Jr. Division), Karnal and that Court shall issue notice to the parties for appearance and proceed with the suits in accordance with law. ---------0.B.S.0------------
