Judgment Jitendra Chauhan, J. A reference received by this Court for transfer of the appeal bearing CRA35A of 17.8.2010 (RBT 12.11.2012), titled as “Chanan Singh vs. Sukhdev Singh”, pending in the Court of learned Additional Sessions Judge, Pathankot, was ordered to be treated as criminal miscellaneous petition. Criminal complaint No.195 of 3.3.2002, titled as “Sukhdev Singh vs. Chanan Singh and others”, was decided by the learned ACJM, Gurdaspur, vide judgment and order dated 23.7.2010. Thereafter, the accused Chanan Singh filed an appeal against the said judgment and order, which is pending before ASJ, Pathakot, being the Sessions Division of Gurdaspur. The matter is with regard to the transfer of the said appeal from Pathankot Sessions Division to Gurdaspur Sessions Division. The complainant hails from village Peeran Bagh, which falls in the territorial jurisdiction of Police Station Sadar Gurdaspur. The complaint was filed before the learned ACJM, Gurdaspur, which was decided on 23.7.2010. Now as per the Gazette Notification dated 28.6.2013, issued by the Government of Punjab, Pathankot has become a new Sessions Division. In view of the said Notification, it is ordered that CRA No.35A of 17.8.2010, titled as “Chanan Singh vs. Sukhdev Singh” pending before Additional Sessions Judge, Pathankot, be transferred from Pathankot Sessions Division, Pathankot to Gurdaspur Sessions Division, Gurdaspur. Copy of the order be sent to both the Sessions Division for necessary compliance. Disposed of accordingly.
