JUDGMENT 1. - The present bail application has been filed under Section 439 Cr.P.C. The petitioner has been arrested in connection with F.I.R. No. 179/2013, Police Station Sagwara, District Dungarpur for the offence under Section 302 I.P.C. 2. As per the allegation, the sister of the petitioner was talking to the deceased. The petitioner did not like that his sister was talking to the deceased. In anger, he slapped his sister and also started beating tire deceased. His relative Dilip reached on the spot and took the injured on his motorcycle for treatment to the hospital. He died on the way. 3. Learned counsel for the petitioner contended that the petitioner was empty handed. The fight was on account of sudden provocation. It was not preplanned and the injures, if at all, were from first blows. Thus, if at all, it is an offence under Section 304-11 I.P.C. 4. Challan has already been filed. 5. Taking into account the facts and circumstances of the case, this Court deems it just and proper to release the petitioner on bail.Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner Raju @ Rajkumar Khant S/o dungar Lal shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs. 40,000/- with two sureties of Rs. 20,000/- each to the satisfaction of the learned trial Judge for his appearance before the Court concerned on all the dates of hearing as and when called upon to do so.Bail application allowed. *******
