Vishnu Chandra Gupta, J.— Heard learned counsel for the applicants and learned AGA for the State. It has been submitted by learned counsel for the applicants that initially the case was registered under Sections 147, 148, 323, 324, 504, 506 IPC but after investigation section 308 IPC was also added. It was further submitted that the applicants were admitted to bail in this case on 02.01.2013 by the lower court. It was further prayed that no offence under Section 308 IPC is made out. The offence under Section 325 IPC is made out. Having considered the facts and circumstances of the case the only prayer made by the petitioner is that in this case the bail application may be considered by the trial court for grant of bail under Section 308 IPC also on the same bond. However, it is provided that in case the applicants surrender before the court below within two weeks from today and move application for grant of bail the court shall consider the request to release them on the same bond and pass any appropriate order which deem fit in accordance with law. With this observation, the petition is finally disposed of. _____________
