Het Singh Yadav, J.— The applicant, who alleged to have been involved in the Case Crime No.459 of 2012, under Sections 420, 467, 468, 471, 504, 506 IPC, Police Station Kemri, District Rampur, has moved this application to enlarge her on bail. Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record. Learned counsel for the applicant argued that the applicant, who is a widow lady, has been falsely implicated in this case because of the party faction in the village. She is the widow of late Chandra Pal, who was the real brother of the complainant. Her name was duly mutated in the revenue papers relating to the landed property left by Chandra Pal. Thus, she has committed no offence in transferring her land in favour of the co-accused Kripal Singh of the same village. The co-accused Kripal Singh has already been granted bail by the another Bench of this Court. The dispute between the parties relating to the land in question is already pending in Civil and Revenue Courts, and it is the Civil Court which will decide that whether the applicant is the widow of late Chandra Pal or not.. Thus, the applicant, who is in jail since 10.4.2013, deserves to be enlarged on bail on the basis of judicial parity also. Learned A.G.A. opposed the bail application and contended that the applicant is not the widow of late Chandra Pal. In fact she is widow of Ram Chandra and getting widow pension, and therefore she is the main accused of committing forgery and cheating. Thus her case is distinguishable from the co-accused Kripal Singh, already granted bail by this Court, hence her bail application deserves to be rejected. Having given my thoughtful considerations to the points pertaining to the nature of accusation, prima facie satisfaction regarding proposed evidence and severity of punishment raised as above by the learned counsel of both the sides and on perusal of record, I am of the view that the applicant deserves to be enlarged on bail for the following reasons :- (a) The case appears to be of civil nature and civil dispute is already pending before the competent Civil and Revenue Courts. (b) The co-accused Kripal Singh, more or less having similar role to the applicant, has already been granted bail by this Court. (c) The applicant is a widow lady.

Kamla Devi involved in the Case Crime No.459 of 2012, under Sections 420, 467, 468, 471, 504, 506 IPC, Police Station Kemri, District Rampur be released on bail on her furnishing a personal bond with two sureties each in the like amount to the satisfaction of the court concerned subject to the following conditions that : - (i) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him to disclose such facts to the Court or to any other authority. (ii) The applicant shall remain present before the Court on the dates fixed for hearing in the case and will co-operate in the trial. In case of unavoidable circumstances for remaining absent, she shall immediately give intimation to the court concerned through counsel and request be made to the trial court that she may be permitted to be present through counsel. (iii) She will not misuse the liberty of the bail and will not repeat any such instance in future. Deviation of any of the above conditions shall entail cancellation of bail. The trial court shall decide the case expeditiously uninfluenced by the observations made herein above. _____________
