JUDGMENT 1. - Present petition has been filed under Section 482 Cr.P.C. praying that a direction be issued to the State of Rajasthan to conduct a fair and an effective investigation in F.I.R. No. 166/2011, registered at Police Station, Gamoorwali, District Sriganganagar, for offences under Sections 498-A and 304-B I.PC. 2. Mr. Bhatnagar, the learned counsel appearing on behalf of the petitioner, has stated that earlier Investigating Officer had submitted affidavit before this Court on 08.01.2013, wherein he stated as under: 4. THAT the investigation was transferred to Circle Officer, Sri Karanpur. Then, accused Kamaldeep was arrested on 11.12.2012 on having found the allegations prima-facie established under Section 304-B and 498-A I.PC. the 'stridhan' was recovered. The whereabouts of accused Shakila could not be known, and therefore, she could not be arrested, and therefore, the arrest warrant from the competent Court has been obtained. The search of accused Shakila Devi is extensively made so as to know her whereabouts, and the search is being continued to arrest her." 3. Learned counsel states that having sworn an affidavit before this Court that Shakila Devi has been found to be guilty of offence under Section 304-B and 498-A Indian Penal Code, she was not put to trial. Learned counsel contends that the Investigating Officer has not acted fairly, and wrong averment was made before this Court in the affidavit filed. 4. Mr. K.K. Rawal, the learned Public Prosecutor for the State, has submitted that Shakila Devi was placed in column No. 2. and thereafter an application was filed under Section 319 Cr.RC. to summon her. That application has been dismissed. 5. In the present case, not only investigation has concluded, charge-sheet has been drawn against the husband of the deceased, but thereafter, an application under Section 319 Criminal Procedure Code has been dismissed. In the midst of trial, no directions for fair investigation, as sought in this petition can be given by this Court. However, petitioner is granted liberty to assail the order, whereby application to summon Shakila Devi under Section 319 Criminal Procedure Code has been dismissed. The petitioner, if so advised, may take recourse to remedy available to him for taking Mr. Manoj Kumar, Additional S.P. Sriganganagar/the Investigating Officer to task, for acting contrary to the averment made in the affidavit submitted before this Court. 6.
