body2013
JUDGMENT Mr. Paramjeet Singh, J. (Oral):- Instant revision petition has been filed under Article 227 of the Constitution of India for setting aside the order dated 04.12.2013 (Annexure P/7) passed by learned Civil Judge (Junior Division), Bilaspur whereby application filed by the petitioners-applicants under Order 1 Rule 10 CPC for being impleaded as party in the suit, has been dismissed. 2. I have heard learned counsel for the petitioners and perused the record. 3. The petitioners have no direct relation with Mangal Sen – defendant and cannot be treated as coparceners. The trial Court has come to the conclusion that the property in hand of Mangal Sen is a separate property and he has every right to dispose of the same in any manner he likes. Even otherwise, the petitioners cannot inherit the property from Mangal Sen. As such, they have no right to be impleaded as party in the suit. 4. In view of above, I do not find any illegality or perversity in the impugned order. 5. Dismissed.
