JUDGMENT 1. - The present petition has been filed under Section 482 Cr.P.C. seeking quashing of F.I.R. No. 21/2013 dated 23.2.2013 registered at Police Station Mahila Thana, Udaipur for offences under Sections 498-A and 406 I.P.C. 2. In the present case, quashing has been sought on the basis of compromise. 3. It is stated that matrimonial dispute has been amicably resolved. 4. A co-ordinate Bench of this Court S.B. Cr. Misc. Bail Application No. 2888/2013, Neeraj v. State and S.B. Cr. Misc. Bail Application No. 2889/2013 had passed the following order: "These anticipatory bail applications under Section 438 Cr.P.C. has been filed on behalf of the petitioners apprehending their arrest in connection with F.I.R. No. 21/2013 registered at the Police Station, Mahila, Thana, Udaipur for the offences under Sections 498-A and 406 I.P.C. Heard learned counsel for the petitioners and the learned Public Prosecutor and the learned counsel for the complainant. Perused the record. Learned counsel for the petitioners and the learned counsel for the complainant submit that the parties have arrived at a compromise in the matrimonial dispute and on application under Section 13-B of the Hindu Marriage Act has been filed on behalf of the parties before the Judge, Family Court, Udaipur. In this view of the matter, the applications for pre-arrest bail deserves to be accepted. Accordingly, these bail applications are allowed and it is directed that in the event of arrest of petitioners Neeraj, Padama and Dr. Rakesh in connection with F.I.R. No. 21/2013, Police Station, Mahila, Thana, Udaipur the petitioners shall be released on hail; provided each of them furnish a personal bond in the sum of Rs. 50,000/- along with two sureties of Rs. 25,000/- each to the satisfaction of the concerned Investigating Officer/S.H.O. on the following conditions- (1) They shall make themselves available for interrogation by Investigating Officer as and when required; (2) They shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him form disclosing such facts to the Court or to any Police Officer; and (3) They shall not leave India without the previous permission of the trial Court. 5. Today, Shri Deepak Menaria for Mr. Pradeep Shah appearing for respondent No. 2 has stated that it has been agreed that Rs.

The compromise has been annexed with the present petition as Annexure 3.Taking into account the statement made by counsel for (he parties and the order passed by the co-ordinate Bench and ratio of law laid down in B.S. Joshi v. Stata of Haryana, (2003) 4 SCC (Cri.) 848 , the present petition is accepted and the impugned F.I.R. along with all subsequent proceedings is quashed.Petition allowed. *******
