JUDGMENT 1. - Hon'ble the Supreme Court in Abuzar Hossain @ Gulam Hossain v. State of West Bengal (three Judges) in para 36 has held as follows: "A claim of juvenility may be raised at any stage even after final disposal of the case. It may be raised for the first time before this Court as well as after final disposal of the case. The delay in raising the claim of juvenility cannot be a ground for rejection of such claim. The claim of juvenility can be raised in appeal even if not pressed before the Trial Court and can be raised for the first time before this Court though not pressed before the Trial Court and in Appeal Court." 2. In the present case, accused-petitioner Mool Singh claims that at the time of alleged commission of offence by him, he was juvenile but unfortunately, on 2.12.2011 his claim of juvenility was dismissed as "not pressed" by Special Judge, (N.D.P.S. Act Cases), Jodhpur because his Advocate was ignorant of law of juvenility. 3. F.I.R. No. 24/2011 under Sections 8/15 and 8/29 of the N.D.P.S. Act, 1985 had been registered against accused-petitioner Mool Singh at Police Station, Goda Andela, District Barmer. The accused-petitioner claims that his date of birth is 10.12.1994 and, accordingly, he was below eighteen years of age at the time of alleged commission of the offence. It is not known that why the learned Advocate of accused-petitioner got his application dismissed as not pressed in the Trial Court. But in the interests of justice and without expressing any opinion on the merits of the claim of juvenility of the accused-petitioner, the impugned order dated 2.12.2011 passed by Special Judge (N.D.P.S. Act Cases), Jodhpur deserves to be quashed and so the impugned order dated 2.12.2011 is hereby quashed and set aside. The learned Special Judge (N.D.P.S. Act Cases), Jodhpur is hereby directed to decide the claim of juvenility of accused-petitioner Mool Singh afresh and in accordance with law preferably within two months from today and then after the trial will proceed under the provisions of N.D.P.S. Act, 1985 A copy of this order be sent to the Special Judge (N.D.P.S. Act Cases), Jodhpur immediately.Revision allowed. *******
