JUDGMENT 1. The Petitioner has preferred the present Civil Revision Petition before this Court, seeking for issuance of an order by this Court in directing the Family Court, Salem, to dispose of F.C.O.P.No.25 of 2007 pending on its file, within a time frame to be determined by this Court. 2. The Petitioner has filed F.C.O.P.No.25 of 2007 before the Family Court, Salem, seeking a relief of Divorce against the Respondent/Wife and further that, the Petitioner has filed the present Civil Revision Petition stating that he has closed his side evidence before the trial Court and for Respondent/Wife's side evidence, the matter has been adjourned time and again. Therefore, the Petitioner/ Husband has invoked the aid of Article 227 of the Constitution of India, praying for issuance of a direction to the Family Court, Salem, to dispose of F.C.O.P.No.25 of 2007, within a time limit to be fixed by this Court. 3. Before the Family Court, Salem, F.C.O.P.No.25 of 2007 (filed by the Revision Petitioner/Husband seeking a relief of Divorce against the Respondent/Wife) and F.C.O.P.No.173 of 2010 filed by the Respondent/Wife seeking a relief of Restitution of Conjugal Rights were tried jointly. PW1 and RW1 were examined and Exs.P1 to P4 were marked. 4. It comes to be known that F.C.O.P.No.25 of 2007 (filed by the Revision Petitioner/Husband) on the file of the Family Court, Salem, has since been disposed of on 15.09.2010, wherein a Decree for Divorce has been granted. However, F.C.O.P.No.173 of 2010 filed by the Respondent/Wife (seeking the relief of Restitution of Conjugal Rights) has been dismissed. 5. In view of the fact that F.C.O.P.No.25 of 2007 on the file of the Family Court, Salem, has been disposed of on 15.09.2010, the relief prayed for in the Civil Revision Petition has become an infructuous one. Viewed in that perspective, the Civil Revision Petition is dismissed as an infructuous one. No costs.
