JUDGMENT 1. - The present application has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case arising out of F.I.R. No. 170/2013 registered at Police Station Khamnor District Rajsamand for the offences under Sections 498A, 304B I.P.C. 2. Earlier bail petition was dismissed by a co-ordinate Bench of this Court (Hon'ble Ms. Justice Nirmaljit Kaur). On 15.10.2013 in the present petition co-ordinate Bench had passed the following order: "This is second bail application under Section 439 Cr.P.C. The earlier bail application was dismissed on the ground that no copy of F.I.R. was placed on record. Hence, the earlier bail application was dismissed only on technical grounds The same was not considered by this Court either on merits or otherwise. Put up on 21.10.2013 before the regular bench." 3. Hence, the present second bail application listed before this Bench. 4. The present petitioner is sister of Vishnu Kumar. Petitioner's brother Vishnu Kumar was married with Sita. A dying declaration of Sita was recorded by Presiding Officer, Gram Nyayalaya, Girva, Udaipur. In her dying declaration, Sita had stated that her husband was having an affair with another lady called Hemu Brahman. 5. It is further stated that on day of occurrence Vishnu Kumar, husband of deceased poured Kerosene oil upon the deceased and put the deceased on fire, after he had lit the matchstick. So far the petitioner is concerned in the dying declaration it has been stated that even though petitioner was present at the spot, she made no attempt to save the deceased. 6. Counsel for the petitioner has submitted that omission to save the deceased will not attract any offence under the provisions of Indian Penal Code. 7. The petitioner is stated to be in custody since August 2013. She is stated to be 18 years old and pregnant. 8. Without commenting on the merits of the case and considering the fact that petitioner is a young lady and pregnant and has played no overt role in the occurrence, this Court is of the view that continuous detention of the petitioner as an under trial is not warranted.Consequently, the present bail application is accepted and the petitioner is ordered to be released on bail during the pendency of the trial to the satisfaction of the trial Court.Bail application allowed. *******
