JUDGMENT 1. This civil revision petition is filed seeking for striking off the pleadings in E.A.No.90 of 2011 in E.P.No.85 of 2007 in O.S.No.222 of 2004 pending on the file of District Munsif Court, Attur. 2. The first respondent herein filed E.A.No.90 of 2011 under Order 21 Rule 97 C.P.C. for recording his obstruction in the execution proceedings. The petitioner herein being the decree holder filed the present civil revision petition seeking for the relief to strike off the said E.A.No.90 of 2011 by raising certain grounds. It is also admitted by the learned counsel for the petitioner that as against E.A.No.90 of 2011, the petitioner herein has already filed counter in the said E.A. 3. Therefore, having filed counter in the said E.A., it is for the petitioner to contest the E.A. before the court below by raising all grounds available to him. I find no grounds to strike off the said petition as contended by the learned counsel appearing for the petitioner. As already stated, the petitioner had filed his counter before the court below and it is for the court below to consider the pleadings made in the said E.A. and pass orders on merits and in accordance with law. It is stated that the E.A. was filed in the year 2011 and being kept for the past two years. Therefore, without going into the merits of the matter, I direct the court below to take up the said E.A.No.90 of 2011 and after hearing both sides and also by giving due opportunity to let in evidence if they so choose to do, pass orders on merits and in accordance with law within a period of 30 days from the date of receipt of a copy of this order. With this observation, the civil revision petition is dismissed. No costs.
