JUDGMENT 1. - The present petition has been filed under Section 438 Cr.RC. for grant of pre arrest bail to the petitioner in a case arising out of FIR No. 21/2013-14 registered at Police Station Excise Circle Alwar-West, for the offences under section 19/54 and Section 14 of Rajasthan Excise Act. 2. It is alleged that petitioner, on seeing the police party, escaped from the spot, leaving a bag which contained six bottles of Indian made foreign liquor and four cans of strong beer. 3. Since recovery has already been effected custodial interrogation of the petitioner is not warranted. Consequently, the present petition is accepted andit is ordered that in the event of arrest, the petitioner shall be released on bail to the satisfaction of the arresting officer. The petitioner shall abide by all the conditions specified under section 438(2) Cr.P.C. and shall appear before the investigating officer as and when called for.Anticipatory Bail Application Allowed. *******
