Sanjay Misra, J.— Heard Sri D.P.Shukla, learned counsel for the petitioner. Notice need not be issued to the respondents no. 1 to 3 in view of the order being passed herein. Learned counsel for petitioner states that the Application No. 74 of 2009 under Section 5 of the Limitation Act filed in Civil Revision No. 15 of 2009 (Adarsh Khalsa Sanyukt Sahkari Kheti Samiti Litd. Vs. Ajab Singh and others) by the respondent no.1 is pending before the District Judge, Gautam Budh Nagar. A prayer has been made to issue a direction to the District Judge, Gautam Budh Nagar to decide the said application expeditiously. In so far as the relief claimed by the petitioner is concerned, no such order requires to be passed by this Court since there is no material available on record to indicate the pendency position of cases before the District Judge, Gautam Budh Nagar and as to how many older cases than of the respondent no.1 are pending before him. Therefore, this petition is finally disposed of by providing that the petitioner can file an expedite application before the District Judge, Gautam Budh Nagar for expeditious disposal of the said application by giving cogent reasons as to why his case should be given precedence over other older cases pending before the District Judge, Gautam Budh Nagar. In case such an expedite application is made by the petitioner, the District Judge, Gautam Budh Nagar should take into account his roster of older cases and pass reasoned order on the expedite application of the petitioner without any further delay. No order is passed as to costs. _____________
