Hon'ble Anjani Kumar Mishra,J.— Pursuant to the order dated 23.7.2013, the case has been put up today as a fresh case. Learned Standing Counsel appearing for the respondents states that instructions in the matter have been received by him. The present Writ Petition has been filed by the petitioner under Article 226 of the Constitution of India, interalia, praying that the respondents-authorities be directed to consider and decide the petitioner's Objection/ Explanation dated 10.7.2013 in accordance with law within reasonable time by a speaking order. It appears that the Licence of the petitioner in respect of the Fair Price Shop in question was suspended by the order dated 28.6.2013 (Annexure-3 to the Writ Petition). By the said order dated 28.6.2013, the petitioner was further called-upon to submit his Written Explanation in regard to the irregularities alleged to have been committed by the petitioner in respect of the Fair Price Shop in question. In response to the said order dated 28.6.2013, the petitioner submitted his Written Explanation dated 10.7.2013, copy whereof has been filed as Annexure-5 to the Writ Petition. The grievance of the petitioner, as raised in the Writ Petition, is that despite submission of the said Written Explanation dated 10.7.2013 before the Sub-Divisional Magistrate, Etah (respondent no.4), no action has so far been taken in the matter. We have heard Shri Uttar Kumar Goswami, learned counsel for the petitioner and the learned Standing Counsel appearing for the respondents. Shri Uttar Kumar Goswami, learned counsel for the petitioner submits that much time has elapsed since the submission of Written Explanation by the petitioner on 10.7.2013 but no action has so far been taken in the matter. Learned Standing Counsel appearing for the respondents, on the basis of the instructions received, submits that the Explanation dated 10.7.2013, submitted by the petitioner, has been received by the respondent no.4, and appropriate decision in the matter will be taken expeditiously. Having regard to the facts and circumstances of the case and having considered the submissions made by the learned counsel for the parties, we are of the view that the interest of justice would be subserved by disposing of the Writ Petition with the following directions: 1. Within three weeks from today, the petitioner will submit an Application before the respondent no.4 alongwith a copy of his Explanation dated 10.7.2013 as well as a certified copy of this order. 2.

On receipt of such Application alongwith the documents, as mentioned above, the respondent no.4 will proceed to consider the matter and decide the same expeditiously, preferably within a period of two months from the date of receipt of the said Application alongwith the documents, after giving reasonable opportunity of hearing to the petitioner as well as all concerned parties and by passing a speaking order in accordance with law. The Writ Petition is accordingly disposed of with the above directions. It is made clear that this Court has not adjudicated the claim of the petitioner on merits. _____________
