Judgment : The Court: The petitioner in this WP under art.226 of the Constitution of India dated February 8, 2013 is alleging that the KMC authorities have not taken any step on the basis of his application for water connection. Admittedly, the petitioner submitted his application for water connection in prescribed form with requisite documents and fee on February 27, 2013. The WP is dated February 8, 2013. I am, therefore, unable to see how the petitioner can make the allegation of inaction on the part of the KMC authorities. His application for water connection could be entertained only if it was filed in prescribed form with all necessary documents and fee. Without doing that he approached this Court stating that he made representations asking the KMC authorities to give him water connection. His informal representations could not be treated as his requisite application for water connection. For these reasons, the WP is dismissed. Nothing herein shall be interpreted by anyone to say that the petitioner’s application for water connection submitted in prescribed form on February 27, 2013 is not to be decided according to law. It is rather hoped that the KMC authorities will decide the application according to law. No costs.
