Judgment :- 1. Sine the matter lies in narrow compass, with the consent of both parties, the writ petition itself is taken up for final disposal. 2. Heard both sides. 3. The petitioner was appointed as a driver in the 3rd respondent Panchayat Union in the year 2000 in the scale of pay of Rs.5200-20200+Grade Pay 2000. 4. According to the petitioner, the drivers working in the Government service have sought for revision of their scale of pay on par with the Junior Assistant. After considering their request, G.O.Ms.No.65, dated 26.02.2011 was issued by the 1st respondent granting the benefit of revision of pay scales to all the drivers. Accordingly, the drivers are entitled to Rs.5200-20200 + Grade pay of 2400. 5. As per letter No.63305/Pay Cell/2010-1, dated 8.11.2010 of Finance (PC) Department, the corresponding selection grade pay to Rs.5200-20200 + 2400 is Rs.9300-34800+4200. 6. The grievance of the petitioner is that he is not given the benefit as per G.O.Ms.No.65, dated 26.02.2011 read with the letter dated 8.11.2010 referred to above. The petitioner made a representation dated 18.03.2013 to the third respondent to grant him selection grade pay of Rs.9300-34800+4200. But, the selection grade pay as required by him is not given sofar, though the petitioner is entitled as per G.O.Ms.No.65, dated 26.02.2011, the letter dated 8.11.2010 and the order dated 22.02.2013 made in W.P.Nos. 133 to 144 of 2012. 7. In these circumstances, the petitioner has filed this writ petition seeking for a direction to fix the selection grade pay as per letter dated 8.11.2010 of the Finance Department and G.O.Ms.No.65, dated 26.02.2011 and to pay the arrears with effect from 1.3.2011, based on his representation dated 18.3.2013. 8. I have perused the G.O.Ms.No.65, dated 26.02.2011 and the letter dated 8.11.2010 and also my order dated 22.01.2013 made in W.P.Nos. 133 to 144 of 2012. 9. In my view, the same issue arose before me in W.P.Nos. 133 to 144 of 2012 and I allowed the writ petitions on 22.01.2013 granting the section grade pay of Rs.9300-34800+4200 to the petitioners therein. Hence, I am inclined to allow this writ petition directing the respondents to grant selection grade pay of Rs.9300-34800+4200 to the petitioner on completion of 10 years of service and to give him the arrears with effect from 1.3.2011, within a period of eight weeks from the date of receipt of a copy of this order. 10. Hence, I am inclined to allow this writ petition directing the respondents to grant selection grade pay of Rs.9300-34800+4200 to the petitioner on completion of 10 years of service and to give him the arrears with effect from 1.3.2011, within a period of eight weeks from the date of receipt of a copy of this order. 10. The writ petition is allowed with the above observations. No costs.
