JUDGMENT 1. - Present bail application has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in a case arising out of FIR No. 98/2012, registered at Police Station, Ananatpur, Kota, for offences punishable under Sections 406 and 420 IPC. 2. The learned counsel appearing on behalf of the petitioner has submitted that as per investigation the petitioner was an accessory to commission of offence. It is submitted by the learned counsel that it has surfaced in the interrogation of the co-accused that the petitioner was extending help to the co-accused by bringing persons/ customers whose amount was taken by the main accused on the promise to double the amount. 3. Counsel appearing for the petitioner has further submitted that the accused who are beneficiary and had received amount, namely Ramdas, Akaram @ Kamal, Irshad Ali @ Arshad Ali @ Ramesh Janid and Sudhir Shrivastava have already been released on bail by the various Co-ordinate Benches of this Court. 4. The learned Public Prosecutor for the State has submitted that all the accused together have duped the complainant of Rs. 3,50,000/- 5. Considering the fact that the period of Police remand is already over and the petitioner is in judicial custody and co-accused have already been released on bail by the various Co-ordinate Benches of this Court continuous detention of the present petitioner, as an under trial, is not warranted. 6. Consequently, the present application is accepted and the petitioner is ordered to be released on bail during the pendency of the trial, to the satisfaction of the trial Court. *******
