JUDGMENT Mr. K.C. Puri, J. (Oral) - Vide this common order, I intend to dispose of two petitions bearing CRM No. M-965 of 2013 titled as, “Mahavir vs. State of Haryana” and CRM No. M-1214 of 2013 titled as, “Mohinder Singh vs. State of Haryana”, as the same have arisen out of the same FIR. 2. Petitioners Mahavir and Mohinder Singh have applied for grant of regular bail in FIR No. 190 dated 12.05.2012 under Sections 199/211/327/342/388/406/419/420/506/120-B of the Indian Penal Code registered at Police Station City Yamunanagar, District Yamunanagar. 3. The prosecutrix (name not disclosed) filed complaint against Ajay Bansal in respect of offence under Section 376 IPC. 4. During the investigation, it is revealed that the prosecution has recorded FIR in order to extract money from Ajay Bansal-accused. It is alleged that ‘4 crore have been transferred in the account of Sonu Bansal at the instance of prosecutrix. Both the petitioners are police officials who are stated to be conspirator for lodging the FIR under Section 376 IPC. The petitioners are stated to be the persons who were instrument in extracting money. 5. The amount of Rs. One lac from each of the petitioners is stated to have been recovered. 6. Learned counsel for the petitioners have stated that no amount was recovered from them. 7. The prosecutrix as well as Sonu Bansal have already been allowed the concession of bail. 8. In these circumstances, both the petitions stand accepted. Both the petitioners namely Mahavir and Mohinder Singh are ordered to be released on bail on their furnishing bail bonds to the satisfaction of trial Court.
