Judgment : The Court: Mr. Roy appearing for KMC submits under instructions that taking cognizance of the allegations made by the petitioner in her letter at p.13 of the W P that the private respondents were erecting unauthorised constructions, the authority concerned of KMC has taken steps for inspecting the premises for deciding whether a case under s.400 of the Kolkata Municipal Corporation Act, 1980 should be registered. In view of the submission, there is no reason to say that the authority decided to ignore the complaint. The WP is disposed of directing the authority concerned of the KMC to intimate the petitioner and the private respondents his decision regarding registration of s.400 case, within a fortnight from the date this order is served. If a s.400 case is registered, then it shall be decided in accordance with law. No costs.
