JUDGMENT 1. - The present bail application has been filed under Section 439 Criminal Procedure Code for grant of regular bail to the petitioners in a case arising out of FIR No. 18/2013 registered at Police Station Nagar, Distt. Bharatpur for the offences under section 143, 323, and 336 IPC. It is stated that later investigating agency has added Sections 147, 148, 149, 341, 324 and 307 IPC. 2. Counsel for the petitioners has submitted that so far as the petitioners are concerned, they have caused simple injuries in the occurrence. 3. Counsel for the petitioners has submitted that even otherwise fire arm injuries were caused by the co-accused of the petitioners on non-vital parts of the body. 4. Counsel for the petitioners has further submitted that it is a case of version and cross-version and recently offence under Section 307 IPC has been added. 5. Petitioners are stated to be in custody from last one and a half month. 6. After hearing counsel for the parties, this Court is of a view that trial will take a long time to conclude and it shall be determined during the course of the trial as to which party was aggressor hence, the continuous detention of the petitioners as under trial is not warranted. 7. Consequently, the present petition is accepted and the petitioners are ordered to be released on bail during the pendency of the trial to the satisfaction of the trial court.Petition Allowed. *******
