Judgment :- 1. Under Section 33 of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995, neither identification of posts nor exemption has been sought for and in this regard, the Association has filed the writ petition and it was dismissed by the learned Judge on the ground that the writ petition on behalf of the Association in service matter, is not maintainable. 3. This Court heard the submission of the learned counsel appearing for the petitioner Association and upon perusal of the materials available on record is not inclined to take a different view from that of the learned Single Judge. Therefore, the writ appeal is dismissed. No costs. However, it is open to the petitioner Association to work out other remedies open to them under law. Consequently, connected miscellaneous petition is closed.
