Judgment : The Court: The petitioner in this WP under art.226 of the Constitution of India dated March, 22, 2013 is seeking a mandamus commanding the respondents to pay him benefits under RORA 2009 with interest. The document at p.12 shows that the petitioner was working in the Calcutta Tramways Company (1978) Limited, and that he retired from the services of the company on November 30, 2008. There is nothing to show that he ever submitted any application making the claim. Without any reason he gave a lawyer’s notice threatening the Managing Director and other officials with legal proceedings. Mr. Deb Roy appearing for the respondents has submitted that if the petitioner makes an appropriate claim, then the authority concerned of the company will examine and decide it according to law. In view of the above-noted situation, I dispose of the WP ordering as follows. If the petitioner makes a claim in an appropriate manner seeking the benefits seeking which he has filed the W P, then the authority concerned of the company shall examine and decide the claim according to law. Compliance within six weeks from the date of receipt of the representation. No costs.
