Judgment : The Court: Mr. Ghosh appearing for the Municipality has submitted under instructions that taking cognizance of the allegations made in the petitioners’ complaint the Chairman of the Municipality has already issued a notice dated March 16, 2013 to the Secretary of the club concerned. He has said that the Board of Councillors or its delegated authority, as the case may be, shall take steps under ss.218 and 220 (if necessary). Advocate for the private respondents has submitted that the private respondents are not erecting any unauthorized constructions. The question is to be examined and decided by the authority under s.218 of the West Bengal Municipal Act, 1993. In view of the above-noted situation, I dispose of the W P ordering as follows. Within a week from the date this order is served the Board of Councillors or its delegated authority, as the case may be, shall intimate the petitioners and the private respondents about the steps taken under ss.218 and 220 of the West Bengal Municipal Act, 1993. If a s.218 case is registered, then it shall be decided after making necessary inquiry, recording proceedings and hearing all concerned according to law. No costs.
