JUDGMENT :- 1. This civil revision petition is filed seeking for the relief of the disposal of the E.P.No. 135 of 2004 in O.S.No.204 of 2000 on the file of the Additional Sub Judge, Mayiladuturai, at an early date. 2. Heard the learned counsel appearing for either side. 3. Learned counsel for the petitioner submits that the E.P.No.135 of 2004, filed in the year 2004 seeking to execute the decree passed in O.S.No. 204 of 2000, is still pending and therefore, a suitable direction may be issued to the Execution Court to dispose of the said execution petition. 4. Learned counsel for the respondents submits that he is not in a position to ascertain the present status of the execution petition. However, it is a categorical assertion of the learned counsel for the petitioner that the execution petition is still pending. W hen that being the assertion of the learned counsel for the petitioner, without going into the merit and other contentions of the parties in the execution petition, I only direct the Court below to take up the E.P.No. 135 of 2004 in O.S.No. 204 of 2000 and dispose of the same on merits and in accordance with law after hearing both sides, within a period of 30 days from the date of receipt of a copy of this order, if otherwise, the Execution Court is not prevented from proceeding with the execution proceedings by any order of the Court. This civil revision petition is disposed of accordingly. No costs.
