Judgment : The Court: The CAN has been filed for restoration of the W P that was dismissed for non-appearance of the petitioners. After hearing advocates for the parties, I am of the view that the CAN should be allowed. Advocate for the petitioners has submitted that the petitioners filed the WP seeking an order directing the KMC authority to give them a copy of the decision concerning the mutation matter in which the petitioners participated after filing an objection and were heard. Mr. Chowdhury appears for eight companies who are not respondents in the W P. He has said that the eight companies who want to contest the W P had been granted mutation and that he has no idea whether the authority hearing the petitioners' objection has given any decision. In view of the small issue involved in the WP, I think it will be appropriate to dispose of it giving a suitable direction to the authority concerned. For these reasons, I allow the CAN, restore the WP to file and dispose of the WP ordering that the authority that heard the petitioners’ objection concerning mutation in favour of the eight companies (mentioned hereinbefore) shall give the petitioners a copy of his decision within a week from the date this order is served. No costs.
