Judgment :- 1. Heard the learned counsels appearing for the parties concerned. 2. This writ petition has been filed praying that this Court may be pleased to issue a writ of Mandamus forbearing the respondents from constructing a public toilet and an announcement room in front of door No.37, Old Trunk Road (GST Road), Pallavaram, Chennai-600 043. 3. At this stage of the hearing of the writ petition, the learned counsels appearing for the respondents have submitted that the plan to use the building put up, at the place in question, as a public toilet has been given up. However, the building put up by the second and the third respondents would be used as an announcement room. 4. Per contra, the learned counsel appearing for the petitioner had submitted that the construction put up by the second and the third respondents has been used as a season ticket counter. The learned counsel appearing for the petitioner had further submitted that a detailed representation would be made, with regard to the inconvenience caused by the respondents in locating the bus shelter, as well as the announcement rooms, adjacent to the compound wall of the property belonging to the petitioner. 5. In view of the submissions made by the learned counsels appearing for the parties concerned, this Court does not find it appropriate to grant the relief, as prayed for by the petitioner, at this stage. However, it is made clear that it would be open to the petitioner to make a detailed representation, to the third respondent, with regard to the inconvenience caused to the petitioner, within a period of four weeks from the date of receipt of a copy of this order. On such representation being submitted, the third respondent shall consider the same and pass appropriate orders thereon, on merits and in accordance with law, considering the issues raised by the petitioner in the representation to be submitted on its behalf, within a period of twelve weeks thereafter. The writ petition is ordered accordingly. No costs. Connected M.P.No.1 of 2011 is closed.
