1. The respondent-writ petitioner feeling aggrieved of the action of appellants for not issuing the tender documents/quotations, so as to enable him to participate in the tender process, filed OWP. No. 153/200. The learned Single Judge after holding that no notice has been issued to the respondent-writ petitioner before taking decision for not issuing the tender documents/quotations, directed the appellants to supply the tender documents/quotations to the respondent-writ petitioner according to its entitlement under rules. 2. We have heard learned counsel for the parties and considered the matter. 3. In order to arrive at proper conclusion, it is deemed appropriate to dispose of this Appeal in the following manner:- The appellants, in order to take final decision as to whether the tender documents/quotations are to be issued or not, to the respondent-writ petitioner, will be at liberty to issue notice to the respondent-writ petitioner and allow him to file his reply to the said notice and grant him opportunity of hearing. Till such a decision is taken, the appellants shall, in tune with the Judgement of the learned Single Judge, issue tender documents/quotations to the respondent-writ petitioner according to its entitlement under rules. The impugned Judgement stands, accordingly, modified. 4. Disposed of alongwith connected CMP(s).
