Judgment : The Court: Mr. Ghoshal appearing for the Municipality has submitted under instructions that on the basis of reliable information regarding contravention of the provisions of the West Bengal Municipal Act, 1993, the authority concerned of the Municipality has already issued a lawful direction and has been taking steps for instituting criminal case keeping in mind the provisions of s.440 of the West Bengal Municipal Act, 1993. In view of the above-noted submission, the W P is disposed of. The authority of the Municipality shall intimate the petitioner within three weeks about the steps taken for prosecution. No costs.
