Judgment :- 1. The tenant is the petitioner. He is aggrieved against the order of eviction passed by the court below. Today, he has filed an affidavit before this court undertaking to vacate and hand over vacant possession of the petition mentioned building to the respondent/landlady on the completion of 9 months from today. It is also stated that the petitioner shall deposit the rents into the Court of Rent Control by the 5th of every month till he vacate the premises and ensure that there are no arrears of rent when the premises is vacated. 2. Paragraph Nos.1 and 2 of the affidavit is extracted hereunder: "1. I shall vacate and hand over the vacant possession to the respondent/landlord; the petition mentioned building on the completion of 9 months from the date of the order in the above CRP dated 16.07.2013. 2. Is hall deposit the rents into the court of the Rent Control (District Munsif, Ariyalur) by the 5th of every month till I vacate the premises and ensure that there are no arrears of rent when the premises is vacated." 3. The affidavit was served on the other side and the learned counsel for the respondent has no objection. 4.Considering the said affidavit of undertaking, the following order is passed: i. The petitioner shall vacate and hand over vacant possession of the petition mentioned property to the respondent/landlady within a period of 9 months from today; ii. The petitioner also deposits the rents into the Rent Control Court (District Munsif, Ariyalur) by the 5th of every month till he vacates the premises and he should not commit any default in making such payment. iii. Any such deposit so made by the petitioner shall be withdrawn by the respondent/landlady by filing appropriate application before the court below. iv. The civil revision petition is disposed of on the above terms. No costs. The connected miscellaneous petition is closed.
