Judgment : The Court: The petitioners in this W P under art.226 of the Constitution of India dated May 2, 2013 are alleging that the Commissioner of Howrah Municipal Corporation (in short HMC) has not taken any step on the basis of their complaint concerning erection of unauthorised constructions by the private respondent. Mr Mukherjee appearing for HMC has submitted that taking cognizance of the allegations the delegated authority of the Commissioner has initiated proceedings and issued a stop work notice. Mr Gupta appearing for the private respondent has submitted that questioning the steps taken by the authority the private respondent has instituted a suit in which the Civil Court has passed an interim order. Mr Roy appearing for the petitioners has submitted that the petitioners are not parties to the suit filed by the private respondent. It is for the authority initiating the proceedings to examine the effect of the order of the Civil Court. I think it will be appropriate to ask him to examine the matter and give his decision. For these reasons, I dispose of the WP ordering as follows. The authority initiating the proceedings shall hear the petitioners and the private respondent, examine the orders passed by the Civil Court and give an appropriate decision, within three weeks from the date this order is served. No costs.
