ORDER : Kuldip Singh, J. This petition is directed against the orders dated 11.3.2013 and 22.3.2013 passed by the Civil Judge (Sr. Division), Chamba. It has been stated by the learned counsel for the petitioners that Civil Suit No.46/2009 was decreed by learned Civil Judge (Sr. Division), Chamba on 30.04.2010 and a decree of Rs. 6,26,130/- along with interest @12% with quarterly rest from the date of institution of the suit till realisation of the amount was passed by the Court in favour of the respondent and against the petitioners. 2. The decree holder has filed execution petition, which is pending before the executing Court. The executing Court has attached the property of the petitioners and now the proclamation is to be issued on 9.4.2013, sale is to be conducted on 24.4.2013 and report is to be made on 9.5.2013. It has been submitted that the petitioners are ready to pay the decretal amount, if certain time is granted to them. The decree was passed on 30.4.2010 and thereafter the bank has filed execution petition, which is pending. According to the learned counsel for the petitioners vide order dated 12.5.2012, the property of both the petitioners has been attached by the executing Court. The execution is pending since long. In these circumstances, no order save and except can be passed that the executing Court will proceed with the execution and shall not confirm the sale if the entire decretal amount along with interest is deposited in the executing Court by the Judgment Debtors on or before 31.5.2013. In case, the Judgment Debtors fail to deposit the entire decretal amount as directed, then it will be open to the executing Court to proceed further in the execution petition after 31.5.2013. It is made clear that the schedule of the sale has not been stayed by this Court. The petition is disposed of, so also the pending application, if any.
