body2013
JUDGMENT :- 1. The petitioner has filed this Writ Petition seeking a direction not to accept the nomination of the 3rd respondent for the post of President of the Kancheepuram District Central Co-operative Bank on the ground that First Information Reports are pending against him. 2. The learned Additional Advocate General has submitted that on merits, the Writ Petition is liable to be dismissed. 3. According to the learned Additional Advocate General, mere pendency of the First Information Report is not a disqualification for election to the post of Board of Director. The 3rd respondent was elected as a Board of Director and the same was not objected and being the Board of Director, he was elected as President for the 2nd respondent Co-operative Bank on 15.7.2013 and assumed office on 17.7.2013. 4. In these circumstances, I am of the view that the petitioner should seek remedy elsewhere questioning the election of the 3rd respondent in the manner known to law. 5. In the result, the Writ Petition fails and the same is accordingly dismissed. No costs. Consequently, connected Miscellaneous Petitions are also closed.
