Judgment :- 1. This Civil Revision Petition is filed seeking for early disposal of O.S.No.46 of 2010 pending on the file of the Sub Court, Vellore. The petitioners herein are the defendants 1 to 4 and 6 in the said suit filed for partition by the first respondent herein. The second respondent is the 5th defendant in the said suit. 2. The learned counsel appearing for the petitioners submitted that these petitioners as defendants 1 to 4 and 6 have already filed a memo before the Court below submitting to the claim of the plaintiff as early as on 12.04.2010. Only the 5th defendant has filed a written statement and contesting the said suit. It is further submitted that the first defendant is a senior citizen aged about 80 years. Thus the petitioners want the early disposal of the suit. 3. Considering the submission made by the learned counsel appearing for the petitioners and also considering the fact that they have already filed a memo before the Court below submitting to the claim in the suit, the Court below is directed to take up O.S.No.46 of 2010 and dispose of the same on merits and in accordance with law within a period of three months from the date of receipt of a copy of this order unless further proceedings of the suit is stayed by any competent Court. I make it clear that I view on the contention of the rival parties. 4. With the above direction, the Civil Revision Petition is disposed of. No costs.
