Judgment :- Since the subject matter in all these Writ Petitions is one and the same, they are taken together and they are disposed of by means of this Common Order. 2.The petitioners challenge the final seniority list of Executive Officer Grade II/Assistant/Head Clerk for the year 2004-2005 issued by the 2nd respondent in its proceedings in Na.Ka.No.6793/2009/A7 dated 12.07.2013. 3. According to the petitioners, they are entitled to be included in the aforesaid seniority list in view of the decision of the Hon'ble Apex Court in SLP No.17335/1994 dated 14.3.1997. 4. It is the case of the petitioners that the seniority list shall be made on the basis of the date of entry into the Ministerial Service. If it is so, the petitioners shall be included in the seniority list, according to the petitioners. 5. It is admitted that the impugned seniority list dated 12.7.2103 itself states that the petitioners could prefer appeal before the Government within 60 days. But, they have not chosen to prefer appeal on the sole ground that they could be reverted from the present post. 6. In the circumstances, the Writ Petitions are disposed of permitting the petitioners to prefer appeal against the impugned seniority list within 60 days from 12.7.2013 and the 1st respondent is directed to dispose of the same on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of the appeal and in the meantime, the petitioners shall not be reverted. No costs. Consequently, connected Miscellaneous Petitions are also closed.
