Judgment :- 1. This Civil Revision Petition is filed against the order dated 28.04.2010 made in M.P.No.371 of 2008 in E.P.No.431 of 2007 in R.C.O.P.No.772 of 2004 on the file of the XII Judge, Court of Small Causes, Chennai. 2. The revision petitioner is the landlady. The respondent is the tenant. 3. Today, the respondent filed an affidavit of undertaking before this Court informing that she has received a sum of Rs.2,95,625/- by way of demand draft from the revision petitioner and she will vacate and handover the vacant possession of the petition premises within a period of three months from today. 4. The relevant paragraph of the said affidavit of undertaking is extracted hereunder:-"1. I am the respondent herein. I know the facts of the case. 2. I submit that I have received the amount of Rs.2,95,625/-payable by the petitioner by D/D from her. 3. I hereby undertake that I will vacate and hand over vacant possession of the petition premises within three months from today." 5. The said affidavit of undertaking was also served on the petitioner's counsel and he has no objection for granting such time. 6. Accordingly, the following directions are passed in this Civil Revision Petition:- 1. The payment of Rs.2,95,625/- by way of demand draft paid by the petitioner to the respondent and acknowledgment of receipt of the same today by the respondent is recorded. 2. The respondent shall vacate and handover the vacant possession of the petition premises to the petitioner on or before 25.10.2013 without driving the petitioner to resort to execution proceedings. 7. With these directions, the Civil Revision Petition is closed. The connected Miscellaneous Petition is also closed. No costs.
