Judgment :- 1. The above civil revision petition is filed against the order dated 6.7.2011 made in I.A.No. 149 of 2011 in O.S.No. 261 of 2005 whereby, the Court below has dismissed the application filed by the petitioner herein under Section 5 of the Limitation Act on the ground that the conditional order to pay the cost to the District Legal Services Authority, Salem, was not complied with. 2. Learned counsel for the petitioner submits that by mistake, instead of paying the cost to the District Legal Services Authority, Salem, the same was paid to the respondents and therefore, the Court below was not justified in dismissing the application. 3. The learned counsel appearing for the respondents filed a memo stating that the civil revision petition may be allowed in order to avoid the unnecessary delay in the trial of the proceedings before the Court below. 4. Appreciating the fairness of the respondents and their counsel, this civil revision petition is allowed and the I.A.No. 149 of 2011 in O.S.No. 261 of 2005 is consequently allowed. The Court below is directed to take up the suit in O.S.No. 261 of 2005 and dispose of the same on merits and in accordance with law within a period of three months from the date of receipt of a copy of this order. No costs.
