Judgment : The Court: Advocate for the Municipality has submitted under instructions that taking cognizance of the allegations concerning erection of unauthorised constructions, the authority concerned of the Municipality has made arrangement for inspection of the premises, and that the premises will be inspected within a day or two for deciding whether it is necessary to register a case under s.218 of the West Bengal Municipal Act, 1993 and issue a notice under s.220 of the Act. In view of the above-noted submission, I dispose of the WP directing the Chairman and the Board of Councillors of the Municipality to intimate the petitioner and the private respondent about the results of the inspection and decision to register a case under s.218 and issue a notice under s.220, within a week from the date this order is served. If a case under s.218 is registered, it shall be decided accordance to law. No costs.
