JUDGMENT :- 1. At this stage of the hearing of the Miscellaneous Petition, in M.P.No.1 of 2013, in W.P.No.29173 of 2012, the learned counsel appearing on behalf of the 3rd respondent had submitted that the gold jewellery in question, seized under the Mahazar, dated 15.10.2012, would be released, on the petitioner complying with the conditions imposed by this Court, in its order, dated 31.10.2012, in M.P.No.2 of 2012, in W.P.No.29173 of 2012. 2. The learned counsel appearing on behalf of the petitioner had submitted that the petitioner would comply with the conditions imposed by this Court, in its order, dated 31.10.2012, in M.P.No.2 of 2012, in W.P.No.29173 of 2012, within a period of seven days from today. 3. In view of the submissions made by the learned counsels appearing on behalf of the petitioner, as well as the 3rd respondent, it is made clear that the 3rd respondent shall release the gold jewellery in question, seized under the Mahazar, dated 15.10.2012, on the petitioner paying 30% of the differential duty, in cash, and for the balance 70% of the differential duty, the petitioner shall furnish a bank guarantee, to the satisfaction of the 3rd respondent. 4. The order, dated 31.10.2012, made in M.P.No.2 of 2012, in W.P.No.29173 of 2012, stands clarified, accordingly. In view of the said clarification made by this Court, the Contempt Petition stands closed. No costs.
