SATYA POOT MEHROTRA, ZAKI ULLAH KHAN

body2013
JUDGMENT : Satya Poot Mehrotra, Zaki Ullah Khan, JJ. It appears that an Advertisement for Auction of Tahbazari Theka for the period of 1.4.2012 to 31.3.2013 in respect of various places, including Muradganj, mentioned in the Advertisement was issued on 12th March, 2012. It further appears that the Tahbazari Theka/Contract was granted in favour of the respondent No. 5. 2. The petitioner is aggrieved by grant of Tahbazari Theka/Contract in favour of the respondent No. 5, and has filed the present Writ Petition seeking various reliefs. 3. From narration of the facts given above, it is evident that the Tahbazari Theka/Contract granted in favour of the respondent No. 5 has been for the period from 1.4.2012 to 31.3.2013. 4. The petitioner has approached this Court by filing the present Writ Petition on 22nd December, 2012, i.e., after about nine months since the commencement of Theka/Contract in favour of the respondent No. 5. 5. The period of Theka/Contract in favour of the respondent No. 5 is going to expire on 31st March, 2013. 6. In view of the aforesaid facts and circumstances of the case, we are of the opinion that it will not be appropriate for this Court to exercise its Writ Jurisdiction under Article 226 of the Constitution of India at such a belated stage. The Writ Petition filed by the petitioner is liable to be dismissed, and the same is accordingly, dismissed.
