Judgment : The Court: Advocate for the petitioners has submitted that the authority concerned of the Municipality has not taken steps on the basis of the complaint concerning erection of unauthorized constructions. Advocate for the private respondent has submitted that the allegation is incorrect, and that the private respondent has obtained sanction for erecting the constructions. Advocate for the Municipality has submitted that the authority concerned of the Municipality has made arrangement for inspecting the premises and deciding the next course of action. In view of the above-noted situation, I dispose of the WP ordering as follows. The authority concerned of the Municipality shall inspect the premises after giving notice to the petitioners and the private respondent, and inform all concerned about its decision taken on the basis of the results of the inspection. Compliance within a fortnight from the date this order is served. If s.218 proceedings are initiated, then the Board of Councillors of the Municipality shall decide the proceedings according to law. No costs.
