Judgment : The Court: Advocate for the Siliguri Municipal Corporation has submitted as follows. There is nothing to show that the petitioner’s admission of the act of forgery referred to in the impugned order of the Commissioner of Siliguri Municipal Corporation dated April 11, 2013 (W P p.24) was recorded. There is only an office note that does not prove the fact stated in the order. Hence the order may be set aside with liberty to the Commissioner to proceed with the matter afresh. In view of the above-noted submissions, I dispose of the WP ordering as follows. The impugned suspension order dated April 11, 2013 is set aside. The authority concerned of the Corporation is at liberty to hear the petitioner and decide afresh the proceedings initiated on the basis of allegations concerning the petitioner’s LBS licence. No costs.
