Judgment : The Court: The petitioner in this WP under art.226 of the Constitution of India dated May 10, 2013 is seeking the following principal relief:-“b) A Writ and/or Order or orders and/or Directions in the nature of a Writ of Mandamus commanding the respondents their employees, Agents, Sub-ordinates and other assignee to cancel the sanction building plan which was sanctioned in favour of the Respondent No. 5.” The sanction in question was granted by the authority concerned of Barrackpore Municipality. On the strength of the sanction the fifth respondent started erecting the building in question. The petitioner contending that the sanction is liable to be cancelled, never submitted any statutory application to the Board of Councillors of the Municipality under s.217. The sanction could be cancelled, if at all, only under s.217. It is, therefore, evident that without making a complaint the petitioner has approached the Writ Court seeking a mandamus commanding the respondents to cancel the sanction. There is no reason to entertain the WP. For these reasons, I dismiss the W P. Nothing herein shall prevent the petitioner from submitting a s.217 complaint to the Board of Councillors and the Board from deciding the complaint according to law. No costs.
