Judgment : 1. The loan application submitted by the minor petitioner was rejected by the Bank on the ground that the admission was under Management quota and she failed to secure 60% marks in qualifying examination. 2. The minor petitioner was admitted for B.SC Nursing for the academic year 2012-2013 at Kongunadu College of Nursing, Tatabad, Coimbatore. Since the minor petitioner has no financial resources to pay the tuition fees, she submitted an application before the respondent for education loan. The application was rejected primarily on the ground that she was admitted under the Management quota and also failed to secure 60% in qualifying examination. 3. The Indian Banks Association has revised the guidelines with respect to the grant of education loan. Now, there is no distinction between the Government quota and Management quota and as such, the first reason given by the second respondent has no basis. The bank cannot be heard to say that the students admitted under the management quota would not be given education loan in view of the guidelines framed by the Indian Bank Association. 4. The second reason appears to be the marks. The regulations issued by various banks show that in respect of MBC and BC candidates, requirement of marks in the qualifying examination is only 50% . The petitioner belongs to MBC and as such, Bank was not justified to reject the application form on the ground that she failed to secure 60% marks in the qualifying examination. 5. The impugned order is set aside and the matter is remitted to the respondent for fresh consideration. 6. The respondent is directed to consider the loan application submitted by the petitioner in the light of the guidelines framed by the Indian Banks Association and taking into account the above observation. Such exercise shall be completed within a period of 15 days from the date of receipt of a copy of this order. 7. The writ petition is allowed to the extent indicated above. No costs.
